Welcome to GrowthMastery.ai. These Terms of Service ("Terms") govern your access to and use of the GrowthMastery.ai platform (the "Service"), operated by Joe McVeen ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that you meet these requirements.

2. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when creating your account and keep it up to date.
  • You must notify us immediately at joe@growthmastery.ai if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Send spam, unsolicited messages, or deceptive content.
  • Upload or distribute malware, viruses, or harmful code.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Scrape, crawl, or use automated means to access the Service without permission.
  • Interfere with or disrupt the Service or servers connected to it.
  • Impersonate any person or entity.
  • Use the Service to create content that is illegal, defamatory, harassing, or infringes on intellectual property rights.

We reserve the right to suspend or terminate accounts that violate these terms at our sole discretion.

4. Payment Terms

  • Paid features are billed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • All fees are quoted in US dollars unless otherwise stated.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — no partial refunds are issued for unused time.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
  • If payment fails, we may suspend access to paid features until the balance is resolved.

5. Intellectual Property

5.1 Our Property

The Service, including its design, code, branding, logos, and documentation, is owned by GrowthMastery.ai and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

5.2 Your Content

You retain ownership of content you create using the Service (funnels, copy, images, etc.). By uploading content, you grant us a limited license to host, display, and process that content solely to provide the Service to you.

5.3 AI-Generated Content

Content generated by AI features (powered by Google Gemini) is provided as-is. You are responsible for reviewing and editing AI-generated content before use. We make no guarantees regarding the accuracy, originality, or legal compliance of AI-generated output.

6. Third-Party Integrations

The Service integrates with third-party platforms including Meta (Facebook/Instagram), Google, Stripe, and others. Your use of these integrations is also subject to the respective third-party terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless GrowthMastery.ai, its operator, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

  • By you: you may close your account at any time by contacting us or using the account settings.
  • By us: we may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will make reasonable efforts to notify you beforehand when possible.
  • Upon termination, your right to use the Service ceases immediately. We may delete your account data within 30 days of termination, subject to legal retention requirements.

10. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state of Texas, USA. Each party bears its own costs unless the arbitrator determines otherwise.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
